- The producer shall ensure every product intended for dispensing to a patient is placed within a child-resistant, light-resistant, tamper-evident container prior to sale or transport to the pharmacy
- A package shall be deemed child-resistant if it satisfies the standard for ‘special packaging’ as setforth in the United States Consumer Product Safety Commission’s “poison prevention packaging”as found in 16 CFR 1700.1(b)(4) or its successor
- A package shall be deemed light-resistant if it satisfies the standard set forth in chapter 671,“containers: performance testing,” of the United States Pharmacopeia (USP)
- A package shall be deemed tamper-evident if it clearly indicates prior access to the container
- shall not specifically target individuals under the age of 18 years
- shall not bear any resemblance to a trademarked, characteristic or product-specialized packagingof any commercially available candy, snack, baked good or beverage
- shall not use the words “candy” or “candies”
- shall not use a cartoon, color scheme, image, graphic or feature that might make the packageattractive to children; and

- Adult use marijuana and adult use marijuana products must be prepackaged in child-resistant and tamper-evident packaging or must be placed in child-resistant and tamper-evident packaging at the final point of sale to a consumer;
- Adult use marijuana and adult use marijuana products must be prepackaged in opaque packaging or an opaque container or must be placed in opaque packaging or an opaque container at the final point of sale to a consumer;
- Packaging for multiserving liquid adult use marijuana products must include an integral measurement component and a child-resistant cap; and
- Packaging must conform to all other applicable requirements and restrictions imposed by rule by the department.
- May not be labeled or packaged in violation of a federal trademark law or regulation or in a manner that would cause a reasonable consumer confusion as to whether the marijuana or marijuana product was a trademarked product;
- May not be labeled or packaged in a manner that is specifically designed to appeal particularly to a person under 21 years of age;
- May not be labeled or packaged in a manner that obscures identifying information on the label or uses a false or deceptive label;
- May not be sold or offered for sale using a label or packaging that depicts a human, animal or fruit; and
- May not be labeled or packaged in violation of any other labeling or packaging requirement or restriction imposed by rule by the department.

- Pursuant to COMAR 10.62.24.01 and 10.62.29.01, all medical cannabis finished products mustbe individually packaged at the original point of processing, and product packaging must:
- Be plain: Packaging is uniform in color and texture, and may include the product name, manufacturer name, and manufacturer logo.
- Be opaque: Package contents are not visible from outside of the package.
- Display the Universal Symbol issued by the Commission.
- A medical cannabis finished product package shall not:
- Bear any resemblance to a commercially available candy, snack, baked good, or beverage.
- Contain any statement, artwork, or design that could reasonably mislead any person to believe that the package contains anything other than a medical cannabis finished product.
- Contain a design, an illustration, a picture, or a representation that encourages or represents the recreational use of cannabis, or promotes cannabis for use as an intoxicant.
- Bear any seal, flag, crest, coat of arms, or other insignia that could reasonably mislead any person to believe that the product has been endorsed, manufactured, or used by any state, county, or municipality, or agency.
- Contain any cartoon, color scheme, image, graphic, or feature that might make the package attractive to children.
- Medical cannabis packaging may not contain any medical or therapeutic claims unless:
1. The claim is supported by substantial clinical data or evidence, and
2. The packaging also includes information on the most significant side effects or risksassociated with the use of cannabis. - Must be Food safe and comply with the food additive requirements established in 21 CFR §§174- 178
- Must be Tamper-evident: The package must have one or more indicators or barriers to entry that, if breached or missing, can reasonably be expected to provide visible evidence to patients that tampering has occurred.
- Must be Child-resistant: The packaging must comply with 16 CFR §1700, et.seq. – Poison Prevention Packaging Act of 1970 (e.g., is designed or constructed to be significantly difficult for children under 5 years of age to open, but not difficult for adults to use properly). If the packaging is intended for multiple openings, it must be capable of being resealed and sustain being child-resistant after the container or package has been opened.○ Note: For all other medical cannabis products, a patient or caregiver may request child resistant packaging.

- Child-resistant Packaging. Licensees licensed subject to 935 CMR 500.050(4) shall ensure that all Marijuana Products that are provided for sale to Consumers by a Licensee shall be sold in child-resistant packaging. Licensees licensed subject to 935 CMR 500.050(2) shall ensure that all Finished Marijuana Products provided at wholesale for delivery to Consumers by a Marijuana Delivery Operator shall be sold in child-resistant packaging. To comply with 935 CMR 500.105(6), Licensees shall ensure:
- That to the extent it is not Unreasonably Impracticable for the specific type of product, Marijuana Products are packaged in containers that are:a. Opaque and plain in design;
- Do not use bright colors, cartoon characters and other features designed to appeal to minors;
- Resealable for any marijuana product intended for more than a single use or containing multiple servings; and
- Certified by a qualified child-resistant packaging testing firm that the packaging complies with the most recent poison prevention packaging regulations of the U.S. Consumer Product Safety Commission as included at 16 CFR 1700: Poison Prevention Packaging.
- That where compliance with the requirements of child-resistant packaging is deemed to be Unreasonably Impracticable, Marijuana or Marijuana Products shall be placed in an exit package that is:
- Capable of being resealed and made child-resistant resistant again after it has been opened;
- Includes the following statement, including capitalization, in at least ten-point Times New Roman, Helvetica or Arial font: "KEEP OUT OF REACH OF CHILDREN."; and
- Is certified by a qualified third-party child-resistant packaging testing firm that the packaging complies the most recent poison prevention packaging regulations of the U.S. Consumer Product Safety Commission as included at 16 CFR 1700: Poison Prevention Packaging.
- Packaging for Marijuana or Marijuana Products sold or displayed for Consumers, including any label or imprint affixed to any packaging containing Marijuana, Marijuana Products or any exit packages, may not be attractive minors. Packaging is explicitly prohibited from:
- Using bright colors, defined as colors that are "neon" in appearance;
- Imitating or having a semblance to any existing branded consumer products, including foods and Beverages, that do not contain marijuana;
- Featuring cartoons;
- Featuring a design, brand or name that resembles a non-cannabis consumer product of the type that is typically marketed to minors;
- Featuring symbols or celebrities that are commonly used to market products to minors;
- Featuring images of minors; and
- Featuring words that refer to products that are commonly associated with minors or marketed to minors.
- Packaging of Multiple Servings.
- Packaging for Marijuana Products sold or displayed for Consumers in multiple servings shall include the following statement on the exterior of the package in a printed font that is no smaller than ten-point Times New Roman, Helvetica or Arial, including capitalization: "INCLUDES MULTIPLE SERVINGS".
- Packaging for Marijuana Products in solid form sold or displayed for Consumers in multiple servings shall allow a Consumer to easily perform the division into single servings.
- Edibles in a solid form shall be easily and permanently scored to identify individual servings.
- Notwithstanding 935 CMR 500.105(6)(c)2.a., where a product is unable, because of its form, to be easily and permanently scored to identify individual servings, the product shall be packaged in a single serving size. The determination of whether a product can be easily and permanently scored shall be decided by the Commission consistent with sub-regulatory guidelines established by the Commission and provided to Licensees.
- Packaging for Marijuana Product Beverages shall be packaged solely in a single serving size. Multiple-serving Beverages are strictly prohibited for sale.
- Each single serving of an Edibles contained in a multiple-serving package shall be marked, stamped or otherwise imprinted with the symbol issued by the Commission under935 CMR 500.105(5) that indicates that the single serving is a Marijuana Product.(
e) Serving size shall be determined by the processor, but in no instance shall an individual serving size of any Marijuana Product contain more than five milligrams of delta-nine-tetrahydrocannabinol (A9-THC) subject to the testing variance specified in 935 CMR 500.160(12).
(f) CMOs shall comply with the packaging requirements in 935CMR500.105(6)foradult use sales or 935 CMR 501.105(6) for medical use sales.

- (1) All packaging of marijuana and marijuana products shall:
- (a) protect the product from contamination and shall not impart any toxic or deleterious substance to the marijuana or marijuana product;
- (b) be capable of being resealed if the package contains more than one serving size;
- (c) not primarily appeal to children. Packaging that primarily appeals to children includes but is not limited to packaging that:

- (d) not bear any reasonable resemblance to the trademarked or characteristic packaging of any commercially available product including but not limited to candy, snacks, baked goods, or beverages.
- (2) All marijuana and marijuana products provided to customers at the point of sale shall be in exit packaging that:
(a) is child resistant as defined in ARM 42.39.102;
(b) is opaque; and(c) contains the warnings required by 16-12-215, MCA, in the format required by 16-12-208, MCA.
- (3) Drinkable marijuana products that contain more than one serving per package must include a device or mechanism for measuring a single serving of the product.
- (4) Exit packaging of marijuana and marijuana products provided to customers at the point of sale may not contain any other information or design elements than what is allowed under 16-12-208(6)(b)(ii), MCA.

- When sold at a retail marijuana store, any product containing marijuana must bepackaged in child-resistant packaging in accordance with 16 C.F.R. § 1700 or the standards specified in subsection 2 or 3, and maintains it child-resistant effectiveness for multiple openings prior to leaving the retail marijuana establishment in the hands of the consumer .
- Except as otherwise provided in subsection 3, marijuana products in solid or liquid form must be packaged in plastic which is 4 mils or more in thickness. Any container or packaging containing usable marijuana and/or marijuana products must protect the contents from contamination and must not impart any toxic or deleterious substance to the usable marijuana or marijuana product.
- Marijuana products in liquid form shall be sealed using a metal crown cork-style bottle cap. The container shall clearly demark each serving of marijuana in a way that enables a reasonable person to intuitively determine how much of the product constitutes a single serving of active THC.(a) The portion of the container that clearly demarks each serving of marijuana need not be opaque; or(b) The container shall include a device that allows a reasonable person to intuitively measure and serve a single serving of active THC.
- If the package or container containing the usable marijuana or marijuana products is not already placed inside a child resistant package then the marijuana retail store must place the marijuana and/or marijauna products into an exit package that is child resistant.

- Containers used for edible cannabis products or edible cannabis finished products shall befood-grade or GRAS and must not impart any toxic or deleterious substance to the packaged product;
- Containers used for topical cannabis products and topical cannabis finished products must be suitable for the intended purpose and must not impart any toxic or deleterious substance to the packaged product;
- Child-resistant container. Unless otherwise provided, containers shall be child-resistant. If the product is multiple use, or contains multiple servings, it shall also be packaged in a container that is resealable and continually child-resistant;
- Cannabis finished products that contain only cannabis flower must be packaged in opaque and resealable containers and are not subject to the child resistant container requirement.
- Containers shall be compostable and recyclable, or made from recycled materials.
- Bundled single-serving edible cannabis finished product. Single-serving edible cannabis finished products that are placed into a child-resistant container may be bundled into an exit package;
- Multiple-serving liquid edible cannabis finished product. Each liquid cannabis finished product that is a multiple-serving edible cannabis finished product shall be:(a) packaged in a structure that uses a single mechanism to achieve both child- resistant properties and accurate pouring measurement of each liquid serving in increments; and(b) the measurement component is within the child-resistant cap or closure of the bottle and is not a separate component

- All retail packages must be child-resistant, tamper- evident, and fully enclose the product. The retail package must be sealed in a way that protects against light and other contaminations that may potentially damage the product during storage. The retail package must not pass on any toxic or harmful substance to the cannabis product. If the package contains multiple servings, the package must be resealable. A retail package is required. A marketing layer is optional.
- Cannabis packaging cannot contain bright colors that are “neon” in appearance, including any color which, when listed in a form ofhue, saturation, and lightness, has a saturation value greater than 60%.
- Cannabis product packaging cannot be made of plastic, unless containing a minimum 25% post- consumer recycled content. Licensees must comply with this requirement by January 1, 2024, unless otherwise authorized by the Board.

- 1. In general, packaging that is intended for consumer purchase at a retail location shall be reusable* and shall not be plastic*. Examples of reusable, non-plastic packaging materials include glass, tin, cardboard, and bamboo.a. This rule does not apply to packaging used solely for the transfer of cannabis or cannabis products between licensees.
- 2. Consumer packaging for cannabis* must be opaque and child-deterrent*.
- 3. Consumer packaging for cannabis products* must be opaque and child-resistant*.
- 4. Packages and containers that hold cannabis and cannabis products must protect those itemsfrom contamination and must not expose the cannabis and cannabis products to any toxic or harmful substance.

- 1. Child resistant packaging consistent with 16 C.F.R. Part 1700, Poison Prevention Packaging Act; or 2. In plastic that is two mil or greater in thickness, heat sealed without an easy-open tab, dimple, corner, or flap that will protect persons under the age of twenty-one from accidental exposure to cannabis edibles in solid form.
